GENERAL TERMS AND CONDITIONS OF SALE
La Bastide de Damien
1. Purpose
These General Terms and Conditions of Sale define the respective rights and obligations of La Bastide de Damien and its guests in connection with reservations and stays at the property.
Any reservation implies full and unconditional acceptance of these General Terms and Conditions of Sale.
2. Identification of the Property

3. Characteristics of the Property
The property cannot accommodate children or minors, even when accompanied by an adult.
The number of guests is deliberately limited to a maximum of 10 per day in order to ensure tranquillity, privacy and a high standard of service. Persons who have not booked a stay at the property are not permitted on the premises. Upon request, adult visitors from outside the property may join resident guests for dinner.
Accommodation capacity and access conditions: our rooms and suites are exclusively designed for two guests. No additional friends, family members or photographers may be accommodated in addition to the two registered occupants.
Our accommodation is not designed to accommodate pets. If this condition is not respected, an additional charge of €80 per day will apply.
Electric Vehicle Charging
We regret that we are unable to provide an electric vehicle charging station. Charging from a conventional mains power supply is also not available.
4. Reservations
4.1 Booking Methods
Reservations may be made:
- through the official website;
- by telephone;
- by email; or
- through partner booking platforms.
4.2 Booking Confirmation
A reservation becomes firm and final once it has been registered, which entails full payment for the stay.
A confirmation email is sent to the guest within 72 hours of the reservation.
5. Rates
Rates include:
- accommodation;
- access to the private facilities provided with the reserved suite.
Unless otherwise stated, rates do not include:
- optional extras and additional services;
- tourist tax, payable on site at the applicable rate.
La Bastide de Damien reserves the right to modify its rates at any time. The applicable price is the rate in force at the time the reservation is made.
6. Payment
6.1 Accepted Methods of Payment
- Bank card. The bank card must belong to one of the guests staying at the property.
- Bank transfer. The bank account used must belong to one of the guests staying at the property.
- Cash, within the limits permitted by law.
7. Cancellation and Amendment Policy
7.1 Cancellation by the Guest
Given the deliberately limited capacity of the property — a maximum of 10 guests per day — and the personalised preparation required for each stay, the following conditions apply:
- Before making any payment, the guest is informed that the reservation is non-cancellable and non-refundable. This information is clearly displayed on the website.
- A request to change the dates of a stay may be submitted up to 20 days before the scheduled arrival date, subject to availability. Any request to reschedule a stay will only become effective following written confirmation from us.
- Once this 20-day deadline has passed, no amendment can be accepted.
In order to protect against the consequences of unforeseen circumstances preventing travel, such as illness, accident or cancellation of annual leave, we strongly recommend that guests take out SAFEBOOKING cancellation insurance when making their reservation.
The insurance may be purchased through the SAFEBOOKING subscription page for La Bastide de Damien.
By way of example, for a one-night stay on 23 July 2027 costing €519, the additional cost of the insurance is €23.36, representing a reasonable investment for greater peace of mind when making a reservation.

7.2 Reservations Made Using Gift Cards
Any reservation made using a gift card is firm and final and is non-cancellable and non-refundable, under the same conditions as standard reservations.
8. Right of Withdrawal
Pursuant to Article L221-28, 12° of the French Consumer Code, the statutory right of withdrawal does not apply to accommodation services provided on a specific date or during a specific period.
The non-cancellation provision set out in Article 7 of these General Terms and Conditions falls within this legal framework.
9. Arrivals and Departures
Arrival and departure times are strictly enforced in order to maintain the limited number of people present on the property.
We therefore recommend booking a stay of at least two nights in order to enjoy a full day at the property.
Arrival time: from 4:30 p.m.
The hotel is secured by a gate, which will not be opened before this time.
During the preceding hours, our team carries out the meticulous and personalised preparation of the rooms and outdoor areas. The time required for this preparation cannot be shortened, regardless of the circumstances.
Guests may arrive until 11:00 p.m.
Departure time: the room must be vacated no later than 11:00 a.m.
Guests are then granted additional time to leave the property entirely, including the outdoor areas and car park, and must do so no later than 11:30 a.m.
Any unauthorised departure after 11:30 a.m. may result in an additional charge.
We invite guests to check their room carefully before departure. Any item left behind cannot be returned by post but will be kept and made available for collection during a future stay.
10. Dining
The Chef of La Bastide de Damien is Dominique Frérard, renowned for his exceptional Italian-Mediterranean cuisine.
A Michelin-starred Chef, Chef Frérard offers generous and flavourful menus from Monday to Saturday evening at La Table de la Bastide.
Dinner service at La Table begins between 7:30 p.m. and 8:00 p.m.
Guests dining together must select the same menu, except in the event of a specific food intolerance.
Meals at La Table must be booked at least 48 hours before arrival. Any specific dietary requirements must also be communicated within the same timeframe.
Any meal cancelled less than 24 hours before the scheduled dining time will be charged in full.
For guests who do not wish to select one of La Table’s set menus, an à la carte selection prepared by the Chef is available for lunch and dinner.

Like La Bastide de Damien itself, La Table de la Bastide operates according to certain rules that we kindly ask guests to respect, enabling the Chef to provide his service in a calm environment and under the best possible conditions of quality.
Bringing food or beverages from outside the property is prohibited, as a comprehensive food and beverage offering is available on site.
11. Yon-Ka Wellness Centre
In partnership with the prestigious French cosmetics brand Yon-Ka, we offer guests staying at La Bastide de Damien an exceptional selection of treatments.
From facials and body rituals to massages, all of our treatments have been carefully designed to provide our guests with a bespoke sensory experience.
To ensure availability, treatments must be booked at least 48 hours before arrival.
We kindly ask guests to arrive punctually for their appointments.
At the scheduled treatment time, one of our practitioners will collect you from your room and personally accompany you to our treatment room.
For your comfort, we recommend removing personal belongings and jewellery in your room beforehand and wearing comfortable underwear. Disposable underwear is also available in the treatment room.
When booking, guests undertake to inform the practitioner of any health condition, medical treatment or pregnancy.
Massage treatments are strictly prohibited during the first three months of pregnancy.
The property reserves the right to refuse to provide a treatment where it may present a risk to the health of the guest or practitioner.
All treatments provided are exclusively intended for wellness, relaxation and comfort.
Under no circumstances do the treatments provided constitute medical, paramedical or physiotherapy services, nor are they a substitute for medical care.
Any treatment appointment cancelled less than 24 hours before the scheduled treatment time will be charged in full.
12. House Rules and Conduct
Guests undertake to:
- respect the peaceful and high-end nature of the property;
- behave respectfully towards the property, staff and other guests.
Any inappropriate behaviour, damage or failure to comply with these rules may, at the sole discretion of the owner, result in the immediate termination of the stay without refund and, where applicable, charges for any damage caused.
Immediate termination of the stay may notably occur in the event of:
- threats or aggressive behaviour towards staff or other guests;
- any attempt to obtain a benefit, refund or compensation by threatening, whether implicitly or explicitly, to publish a negative review in bad faith, or by publishing such a review;
- unreasonable noise disturbance;
- bringing food or beverages from outside the property onto the premises.
13. Liability
La Bastide de Damien shall not be held liable for:
- the loss, theft or damage of guests’ personal belongings;
- damage resulting from improper use by a guest of equipment made available to them, provided that the relevant operating and safety instructions have been communicated to the guest.
The use of wellness facilities, including the jacuzzi, swimming pool and spa equipment, is undertaken under the guest’s responsibility and in compliance with the instructions displayed or communicated by the property.
Classification and Commercial Designations
As part of its communications and marketing, the property may use the terms “Boutique Hotel”, “Boutique-Hotel”, or references to a high level of luxury and standing.
These terms are used for descriptive and marketing purposes to reflect the experience offered to guests: an exceptional and intimate estate deliberately limited to a small number of independent suites, providing a rare degree of privacy, discretion and personalisation.
The property has developed an approach to hospitality based on bespoke service, tranquillity, personalised hospitality provided directly by the owners, and a deliberately limited capacity enabling an exclusive and private experience.
This philosophy is intended to provide a high-end experience that distinguishes itself from the standards of traditional hospitality, including establishments officially classified as five-star hotels under the applicable regulatory framework.
Through its intimate positioning, the naturally private nature of its spaces, its independent suites with private gardens and wellness facilities, and the individual attention devoted to every stay, La Bastide de Damien seeks to offer a rare form of hospitality in the Aix-en-Provence area, designed for guests seeking privacy, tranquillity and a bespoke experience.
Certain booking platforms, private organisations, partners or specialist media, such as Teritoria or Booking.com, may award the property distinctions, categories, ratings or assessments, including ratings expressed in the form of stars or levels of standing.
Such distinctions correspond exclusively to private assessments, listings or classifications and do not constitute an official classification as a tourist hotel under applicable French regulations, including the Atout France hotel classification system.
14. Force Majeure
La Bastide de Damien shall not be held liable in the event of force majeure or circumstances beyond its control, including extreme weather conditions, administrative decisions, major technical failures or similar events.
15. Personal Data
Personal data collected is used exclusively for the management of reservations and guest relations.
In accordance with the General Data Protection Regulation (GDPR), guests have the right to access, rectify and delete their personal data.

16. Disputes and Applicable Law
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, an amicable solution shall be sought as a matter of priority.
Failing an amicable resolution and in accordance with applicable regulations, consumer guests may refer the dispute, free of charge, to a consumer mediator.
If no amicable agreement can be reached, the competent courts shall be those having jurisdiction over the registered office of the property, subject to mandatory jurisdictional rules applicable to consumer disputes.
In accordance with Article L.612-1 of the French Consumer Code, every guest has the right to use a mediation service free of charge for any dispute relating to their stay.

17. Acceptance of the General Terms and Conditions of Sale
Booking a stay at La Bastide de Damien constitutes full and unconditional acceptance of these General Terms and Conditions of Sale.
